Bankruptcy law is one of the hottest practice areas in the legal field today and law firms across the country are expanding their bankruptcy and restructuring practices. J. Andrew Rahl, Jr., a partner at Reed Smith and co-chair of its Commercial Restructuring and Bankruptcy Group, shares the ins and outs of practicing bankruptcy law in the interview below. Can you comment on employment opportunities in the field of bankruptcy law? Employment opportunities are growing in this field. This growth is a reflection of the credit crunch and the economic cycle of bankruptcy and restructuring lawyers. It̢۪s hard to speculate about the long-term economic cycle but I suspect the bankruptcy boom will last a least a couple of years. Many law firms are expanding their bankruptcy practices. We recently added a new associate to our group. 2. How did you get into the field of bankruptcy law? I̢۪ve been doing this a long time. After graduating from law school in the middle of a recession I went to a firm with a bankruptcy and restructuring practice and found it very interesting. I looked for opportunities to practice bankruptcy whenever I could and by 1990 I was doing bankruptcy full time. 3. What do you enjoy most about practicing in the area of bankruptcy? Corporate bankruptcy touches on almost every aspect of business law. In addition to knowing the bankruptcy code, you have to become a generalist in terms of mergers and acquisitions, corporate and securities, employment, real estate and many aspects of regulatory practice. Practicing in the area of bankruptcy is a lot of fun and every case is different. 4. What challenges are unique to the practice of bankruptcy law? Bankruptcy law lends itself to people who perform well at the last minute under pressure. The bankruptcy timeframe can be a lot shorter than typical litigation. Some litigation goes on for years while many aspects of bankruptcy involve discreet issues that get resolved within a short time period. 5. What tasks are typically performed by an entry-level bankruptcy attorney? What happens in bankruptcy depends on the nature of the matter. It̢۪s not unusual in bankruptcy for junior lawyers to interact with clients and draft legal documents. For example, a first-year lawyer who recently joined our firm was quite pleased to spend three days working on a motion to lift the automatic stay with respect to the security interest of a client who is an equipment lender. He will also participate in arguing the motion. 6. What skills are needed to practice in the area of bankruptcy? One of the interesting things about bankruptcy practice is that it̢۪s a hybrid between litigation and transactional practice. You need both the skills of a litigator and the skills of a transactional lawyer. It doesn̢۪t hurt to have good contract and corporate drafting skills as well. Analytical skills, the kind you learn in law school, are necessary. Speaking ability is important as bankruptcy lawyers spend a significant percentage of their time on their feet arguing in court. Writing ability is also necessary since bankruptcy lawyers draft pleadings, briefs, motions and other documents. 7. How can a new attorney break into this field? Timing is everything in bankruptcy. It is cyclical and the economy does have an impact on bankruptcy work. Now is the time to be looking for opportunities in bankruptcy. New lawyers interested in bankruptcy should look for a firm that has a meaningful bankruptcy practice. Firms are busier now with bankruptcy work.

Many students know about and have used LinkedIn, but I’m still surprised at how many have either never heard of it or who say they started a LinkedIn profile but never finished. The value of LinkedIn is through connections. Building connections on LinkedIn is easy once you understand their value and once you get the hang of it. Once youve accomplished this, you should be able to land that internship. Companies Tap Into LinkedIn for Many Reasons Supervisors usually have their LinkedIn profiles public to reach out and make connections with people currently working or looking to get into the field. Companies can participate in LinkedIn groups where they can communicate with individuals who are interested in the company or in a specific career field or industry. Recruiters and company management can search for people based on their knowledge, skills, and previous experience, and can check out their employment history to see if they would be a good fit for the organization. LinkedIn provides a way for people to find potential contacts with whom they can connect to learn about potential internships or jobs. Create Your Profile The first step, if you already havent, is to create your profile. Here are a few things you may want to consider: Make your profile as professional as possible. Your profile is how you will represent yourself online. It’s important to take the time to create an effective profile on LinkedIn that will get results. Be sure to include all of your past history, such as education, academics, volunteer, activities, summer jobs and internships to represent yourself professionally online. Your LinkedIn profile will act as your online resume, so it’s important that it’s detailed, complete and has no errors. Be honest, truthful and dont embellish. Be sure you use a professional looking photo in your Profile that will make you marketable and recognized across the web. Find People on LinkedIn Build your network. If you connect your email address with your profile, LinkedIn will automatically scour your contacts for any possible connections. You can also search for and connect with people who have worked with or attended school with you. An excellent way to find previous colleagues, managers, professors, peers, and even alumni of your college is to use the “Advanced” button on the right side of the search bar. It is here that you can enter a keyword, first name, last name, title, company, school (college), and location to find people you may want to connect with. You will also get invitations to connect from those who view your Profile and want to connect online. And remember to keep updating your list as you move ahead in your career. Recommendations Are Key Get recommendations. Ask the people youre connected with on LinkedIn to provide a recommendation on your (past or current) performance. This may be a professor or a previous employer. Supervisors and people hiring for internships will check these out, so dont discount their power. And remember to return the favor if youre able to- its a professional courtesy if you can provide a recommendation for someone whos done the same for you. LinkedIn Groups Check with your college or academic department to see if they have a LinkedIn group where you can instantly connect with thousands of people who have already joined and are participating on the site. You can also join other groups based on your professional interests. So its a good idea to search for any groups that may lead to future internships. Search for Internships and Jobs You can search for internships and jobs on LinkedIn. Check out companies and the job search section to uncover opportunities in a career field and location of interest. You can also reach out to your connections to lead you in the right direction. LinkedIn now makes it easier to apply for a position. If you find an internship that you just cant pass up, you may be able to apply directly through the site. LinkedIn has an Easy Apply button that allows you to upload a cover letter and resume that will go directly to the recruiter. If a job doesnt have that button, the Apply function also makes it easy to put your name in the hat. It may direct you to the companys website, landing you on the page for that specific internship. A lot of companies will also take out the guesswork in who is doing the hiring by posting the recruiters name and profile on the internship opportunity on LinkedIn. If you need to, you can message the person directly with any questions you may have. The Bottom Line All you have to do is get started. Once your profile is established, you can begin using all of the functionalities that LinkedIn was set to do. It’s quite easy to maintain and, unlike Facebook, you won’t need to change it on a daily basis. Updating the information every few months is enough and don’t feel that you have to connect with everyone that wants to connect with you. Making the most of the site and your profile may help you get that much-needed internship- and get your career going.

Sometimes a promotion results in an employee taking on responsibility for managing or overseeing the work of other employees. Decision-making authority tends to rise with promotion as well. Promotion vs. Lateral Moves Unlike in a lateral move, the promotion can result in more status within the organization. But, along with the authority and status conveyed with the new position title, comes additional responsibility, accountability, and expanded expectations for contributions. Indeed, one standard joke in organizations that promote employees is Be careful what you wish for... Visually, a promotion moves an employees job up one level on an organizational chart. The new reporting relationships are displayed as vertical lines to boxes below the new level of the employee following the promotion. A promotion is viewed as desirable by employees because of the impact a promotion has on pay, authority, responsibility, and the ability to influence broader organizational decision making. A promotion raises the status of the employee who receives a promotion which is a visible sign of esteem from the employer.   As a sign of the value and esteem that an employee is held in by the employer, the promotion is a visible action that other employees see. In all cases of promotion, the employer is telegraphing to other employees the kinds of actions, behaviors, and values hed like to see in their attitudes, outlooks, contributions, and commitment. Promotion Dilemmas The first dilemma an employer will face is where to post a job vacancy notice. This notice can be an internal posting, an external posting in newspapers or websites, or they may list the opening in both formats. Internal employees must feel as if they have the opportunity for promotion or they begin to feel as if their careers are on hold and there is nowhere for them to progress unless they leave your organization. External applicants bring knowledge and experience from outside of your organization, which is needed for the organization to continue to grow and develop. Most employers decide on a mix unless a job requires skills that the employer knows are not available internally. Whether an employer has time for an internal candidate to get up-to-speed on the skills needed also plays a role in whether an internal candidate is considered for a promotion.   Not All Employees Want a Promotion Promotion is not necessarily the right action to take with every employee. Some employees dont want higher levels of responsibility and authority. They are happy working on the job as valued individual contributors. A promotion is a form of recognition for employees who make significant and effective work contributions. Consequently, a second dilemma arises in organizations since repeated promotions generally place an employee in a management role. Organizations, however, have made promotions the primary method for employees to increase their pay and authority.  Employers are challenged to provide alternative career paths for employees who deserve the benefits and recognition provided by promotion but do not aspire to manage the work of other employees. Individual contributors must be eligible for promotions that recognize and reward their role as contributors. Both visibly and as to inform to the rest of the organization, this recognition demonstrates what the employer values. For example, in a workplace that has a development staff, it may make sense to offer job titles such as Developer 1, Developer 2, Developer 3, and Senior Developer to provide recognition and promotion for employees who are not interested in a management or team leader role. A promotion is a powerful communication tool about what is valued within an organization. Thus, a promotion must be available to employees who play any role in the contribution of work and value. Examples of a Promotion in the Workplace These are examples of employee promotion within the HR department. Promotions look similar in other departments in your organization. Your motivation can be something like helping others or feeling good about yourself, and you can explore many paths to fulfill these desires. If you follow a career path that satisfies you, you will be a more competent professional who delivers better outcomes. 2. Experience Is the Best Teacher When youre starting your first career or jumping into a new one, it can be difficult to identify your natural skills, especially those on which you can capitalize. Youll need to give yourself some time to explore your skills and understand your potential. After gaining some experience, you will be in a better position to identify your strengths and leverage your talent for success. 3. Think in Terms of Career Opportunities Instead of Particular Jobs It is a common mistake to make decisions based on what is happening in the moment.
